ORVA runs the program. The reward is the shop's.

The terms of using the platform, for shop owners and for card holders, in plain words.

Draft for review · The laws of the Sultanate of Oman

01Accepting these terms

These terms govern the use of the ORVA Loyalty platform (“ORVA”, “we”): the orvaloyalty.com website, the shop dashboards, the stamping devices, and the loyalty cards in Apple Wallet and Google Wallet.

A shop owner accepts them when accepting their invitation and activating their account; we record the date and the version accepted. A card holder accepts them when adding the card to their wallet. If you don't agree, don't use the service.

02What the service is

ORVA is a technology platform. We give shops the tools to run a stamp loyalty program: designing and issuing the card, stamping it at the till, and updating it in the phone's wallet.

We are not a party to the relationship between a shop and its customers. The shop sets its program and its reward, gives the reward itself, and is the only one committed to it. We sell nothing to card holders, and we guarantee no shop's reward.

We process the data needed to provide the service under Oman's Personal Data Protection Law and our privacy policy.

03Pilot launch

The service is in a pilot launch with a limited number of shops. We may change its features, stop some of them or fix errors, and it may sometimes be unavailable. We tell shops in advance of any change that affects their programs whenever we can.

Part A · For shop owners

Our relationship with a shop: a subscription to a technology platform.

04Eligibility and your account

The account holder must be 18 or over, represent a licensed business, and give accurate details.

Accounts are by invitation from ORVA. The holder protects their password and their two-step verification, and tells us at once if they suspect someone else has signed in. They are responsible for what is done through their account.

05Trial, subscription and billing

Every shop starts with a free trial whose length is set in its invitation; after it, the program continues with a paid subscription. We agree the price, payment method and payment dates with each shop in writing, in Omani rials.

If the trial ends without a subscription, or a payment is late, the program stops: no new stamps and no new cards, and the shop's dashboard closes except for the contact screen. Nothing is deleted: the cards stay in customers' wallets with their stamps, and everything comes back as it was as soon as the subscription starts.

06The shop's responsibilities

The shop is responsible for:

  • Honouring every reward it announces, on the terms written on the card, for every card holder who completes the stamps.
  • The accuracy of what it says about its program, and following the laws that apply to its business, including consumer protection laws.
  • Its staff and what they do with the stamping devices, keeping their PINs safe, and telling us at once about a lost device or a staff member who has left, so we can stop it.
  • The devices it stamps with, and protecting them from use by anyone but its staff.

ORVA does not bear the cost of any reward, and does not compensate for a reward a shop did not give.

07Card limits and fair use

Each shop has a limit of active cards under its subscription. Once it is reached, no new cards are issued, and existing customers carry on as usual.

To protect against fraud the platform sets technical limits: how many cards can be issued from one network in an hour, the time between two stamps on the same card, and the daily stamp limit the shop chooses. These limits may not be worked around.

We watch for unusual patterns and alert the shop to them, without ever stopping a stamp automatically.

08The shop's content

The shop's name, logo, colours and program texts remain the shop's own. The shop gives us a limited, non-exclusive, free licence to use them only to show its cards and run its program, for as long as it subscribes and its cards remain in customers' wallets.

The shop confirms it has the right to use what it uploads, and that it infringes no one else's rights and no law. We may refuse or remove any content that does.

Part B · For card holders

The shop issues the card through ORVA; the reward is the shop's.

09Using the card

  • The card is free, and needs no account and no app.
  • The reward is given by the shop, not by ORVA. Its terms are written on the card: the stamps needed, the reward, and any condition the shop sets.
  • Stamps and rewards are not money, have no cash value, and cannot be exchanged for money.
  • A card cannot be transferred or sold, and the stamps of two cards cannot be combined.
  • The reward is redeemed at the shop itself, by scanning the card at the till.

10When a program stops or a shop closes

A shop may pause its program, end it, or close. The card then stays in your wallet with its stamps, and shows the program's state.

Rewards owed are the shop's responsibility alone. ORVA does not give the reward or pay in its place, but we will help you reach the shop if you need to.

Part C · For everyone

11Acceptable use

No one may:

  • Tamper with stamps or rewards, such as stamping a card without a purchase, a staff member stamping a card they hold with other people's purchases, or copying someone else's card.
  • Try to break into the platform or get around its protection, or test its security without our written permission.
  • Send automated requests in bulk, or disrupt the service.
  • Use the platform for anything unlawful.

We stop any account, device or card that does, and may report it to the authorities. If you find a security weakness, tell us at [email address — to be added].

12Intellectual property

The platform, its design, its software and the ORVA brand are ours. These terms give you no right in them beyond using the service as they describe.

13Third-party services

The card is kept in Apple Wallet or Google Wallet, whose use is governed by Apple's and Google's own terms and policies. We don't control these services and are not responsible for their outages, their changes or late notifications from them. If a card update is late, your stamp is safe in our record.

14Disclaimer and limits of liability

We provide the service “as is” and “as available”. We do our best to keep it running, but we don't guarantee it is free of errors or uninterrupted.

As far as Omani law allows, we are not liable for indirect losses, such as lost profit or harm to reputation. Our total liability to a shop is what it paid us for the three months before the incident. Nothing in these terms limits a liability that the law does not allow to be limited.

15Ending the service

A shop owner may end their subscription at any time by telling us in writing. We may suspend or end an account for a breach of these terms, non-payment, or at the request of an authority, telling the shop whenever we can.

After it ends, the cards stay in customers' wallets, and we handle the data as the privacy policy describes. A card holder can stop at any time by removing the card from their wallet.

16Changes, governing law and disputes

We may change these terms. We publish the change here and update the “last updated” date, and we tell shop owners about any material change 30 days before it takes effect. Continuing to use the service after that means you accept it.

These terms are governed by the laws of the Sultanate of Oman, and the Omani courts have jurisdiction over any dispute arising from them. Before that, we aim to settle any disagreement amicably: write to us at [email address — to be added].
